Sooner or later, some employees end up in a disciplinary or investigatory meeting with a supervisor or HR. It’s stressful, and it’s normal to want a record of what was said.

That’s why people ask questions like:

“Can I secretly record the meeting in Canada? Is it legal to record a conversation without everyone’s consent?”

Others are dealing with workplace bullying or harassment and wonder:

“In Canada, can I record my colleague bullying me?”

Employers ask the flip-side too: can they record an employee misbehaving, or record an investigation meeting?

Important: This is general information, not legal advice. Union rules, workplace policies, and provincial/federal privacy laws can change the outcome even if something isn’t “criminal.”

⚖️ Is it legal to record your conversations at work (Canada)?

Under section 184 of the Criminal Code, the key criminal issue is whether you’re intercepting a private communication without lawful consent. Canada is commonly described as a “one-party consent” country, meaning a recording is generally not a criminal offence if one participant to the conversation consents (including you).

In plain English:

  • Usually legal (criminal-law-wise): recording a meeting you are part of (even if the other person doesn’t know).
  • Usually illegal: recording a conversation you’re not part of (for example, leaving a device in a room to capture other people’s private discussion).

Two big “don’t be dumb” warnings:

  • Criminal law isn’t the whole story. Something can be “not criminal” and still get you disciplined or fired, or expose you to a lawsuit (privacy).
  • Context matters. Recording in places with strong privacy expectations (like washrooms/change rooms) is a different legal universe.

🎙️ Can I record a conversation with my boss (Canada)?

Generally, yes—if you’re a participant, the Criminal Code usually won’t make it a crime.

But “can I” and “should I” are not the same question. Secret recordings often blow up trust fast, and workplaces run on trust (even the messy ones).

🔥 Will I be fired if I record a conversation at work?

Possibly. In many non-union workplaces, an employer can terminate without cause as long as they provide required notice or pay (and they still can’t fire you for illegal reasons like discrimination or reprisal).

Also, not every workplace fits the “no-reason” model:

  • Unionized: discipline/termination usually must meet the collective agreement standards.
  • Federally regulated (non-union): some employees can file an unjust dismissal complaint within strict timelines.

If your employer discovers you secretly recorded them, they may:

  • terminate without cause (with notice/pay), or
  • allege just cause (no notice/pay) depending on how serious the breach was and how much it damaged trust.

Courts have treated secret recordings as a serious problem in some cases. For example, in Hart v. Parrish & Heimbecker, Limited (MBQB), the court criticized secret recordings as breaching confidentiality/privacy obligations and workplace conduct expectations.

🛑 Can I record a conversation with a bully / workplace harasser?

The same Criminal Code principle usually applies: if you’re a participant, it’s generally not a criminal offence to record.

That said, recording is not automatically a “win.” It can still trigger discipline, and it can still create privacy risk. If you’re thinking about recording because you feel unsafe or trapped, focus on safer evidence options too: written notes right after incidents, saving emails/texts, witnesses, and reporting through proper channels.

Practical next steps (don’t white-knuckle this alone):
• If you’re in Ontario, HRTO applications are generally due within one year of the discrimination/harassment (or the last incident in a series). HRTO time limits

🏛️ Are secret recordings admissible in court in Canada?

It depends on the forum (court vs. labour arbitration) and the facts. Some decision-makers admit relevant recordings; others exclude them for fairness, privacy, or labour-relations reasons.

A commonly cited example in family law is Mazur v. Corr (ABQB), where the court discussed admitting recordings if the other side has notice and the evidence is relevant—though later cases also warn against encouraging covert recording.

🏢 Can an employer record an employee?

An employer can sometimes record workplace conversations, but they still have to deal with privacy obligations and “minimum necessary” collection. The Office of the Privacy Commissioner has guidance on balancing an employer’s management needs with employee privacy rights, especially where federal privacy law applies.

If an employer is considering recording, the smart approach is boring but effective:

  • have a clear written policy,
  • use the least intrusive method that can work,
  • limit access/retention, and
